1.1 The True Blue website, accessible at www.clubtrueblue.com (“the website”), is owned and operated by True Blue Developments Pty Ltd ABN: 66111409486 on the World Wide Web (“WWW”).

1.3 This is a legal agreement between you and True Blue Developments Pty Ltd with respect to your access and use of the website.

2.1 True Blue Developments Pty Ltd may change the Terms and Conditions at any time.

3. Your Registration Obligations

3.6 Each member will be designated their own login name and password, this will be known only to True Blue Developments Pty Ltd and the individual user. You are responsible for the use of your account and for preventing unauthorised use of the account. 
3.7 True Blue Developments Pty Ltd will not accept any registration that True Blue Developments Pty Ltd suspects is being made by or on behalf of a member who has had their registration previously terminated or refused.
4. Payment Methods
4.1 Clubtrueblue.com accepts payment via major credit cards including VISA, MASTERCARD and BANKCARD.
5. Refunds
5.1 Please choose carefully as we do not give refunds simply because you changed your mind or make a wrong decision.
5.2 Where a duplicate payment may have been received by clubtrueblue.com and has been verified by both parties and their financial institutions, a refund will be made.
Please note: Refunds can take up to 10 working days to show up on your bank or credit card statement. This is a condition of the financial institutions involved.
6. Privacy Policy
6.1 Registration data and certain other information about you is subject to True Blue Developments Pty Ltd’s privacy policy.

7.  Member Account, Password and Security
7.1 You will receive a password and account designation upon completing the website’s registration process. 
7.2 You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account.
7.3 You agree to immediately notify True Blue Developments Pty Ltd of any unauthorised use of your password or account or any other breach of security. 
7.4 True Blue Developments Pty Ltd cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 5.

8.6  True Blue Developments Pty Ltd reserves the right at all times to monitor communications on the website. 
8.7  True Blue Developments Pty Ltd reserves the right to disclose any information True Blue Developments Pty Ltd deems necessary to ensure your compliance with these Terms of Use.
8.8 You agree that any personally identifiable information given out through the website via your account will always be done so with caution. True Blue Developments Pty Ltd does not control or endorse anything discussed on the website and, therefore, True Blue Developments Pty Ltd specifically disclaims any liability with regard to any actions resulting from any participation in the website using your account.

11.  Indemnity

12.2 You agree that True Blue Developments Pty Ltd shall not be liable to you or any third-party for any termination of your access to the website.

You and True Blue Developments Pty Ltd agree to submit to the personal and exclusive jurisdiction of the courts located within the State of Victoria, without giving effect to any principles of conflicts of laws. 
15.3 If any part of this Agreement is found to be void, unlawful, or unenforceable then that part will be deemed to be severable from the balance of this Agreement and the severed part will not affect the validity and enforceability of any remaining provisions. 
15.4  The failure of True Blue Developments Pty Ltd to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. 
15.5  You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the website or the Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred.

17.1 The website provides links to sites on the WWW owned and operated by third parties and which are not under the control of True Blue Developments Pty Ltd.

The links sites are not under the control of True Blue Developments Pty Ltd, and as a result True Blue Developments Pty Ltd is not responsible for the contents of any linked site or any link contained in a linked site. 
17.3  True Blue Developments Pty Ltd provides the links to other sites as a convenience to you and the existence of a link to other sites does not imply any endorsement by True Blue Developments Pty Ltd of the linked site.
